Criminal Law Versus Civil Law
Civil Law
The scope of civil law are common on obligations and contracts as well as their enforcements. Any other case as long as no crime is involved, it is civil law which govern them. A wrongful act wherein the other party asks for damages is also under the civil law. When we mean civil law, it does not involve any crime. In a civil lawsuit, the criminal defense attorney is the one who will gather all evidences needed on the prosecution.
Those who often face a civil case are organizations and employers who fail to give just benefits to their employees. A person or an entity who claims on their legal compensation or benefit is often called a plaintiff. We call the other party as litigant or defendant, most of the time defendant is used in the court proceedings. It is a must under civil law that all employees must be given just compensations. One proven that the defendant fails to abide with their obligations, they are often required to give the plaintiff their just share.
Some of the subjects or coverage of a civil case includes the following; contracts, commercial operations, workers’ compensation, divorce and custody, corporations, personal injury and estate planning, employment, bankruptcy, and taxes. The aggrieved party is often given monetary compensation, some legal rights, custody and other form of order. There are grave cases that requires imprisonment.
Criminal Law
Criminal law involves crime against other people that include rape, robbery, murder, assault and kidnapping. In other way, it also includes tax evasion, burglary, larceny, smuggling, shoplifting and other forms of theft. Criminal laws also cover those who use and sell drugs, drunk drivers and other crimes against the law. The penalties given to perpetrators are often in the form of a fine and jail. Once proven guilty of the crime, an order or sentenced will be given to the perpetrator.
Under the criminal law, the person who is often accused of a certain crime is often charged with formal accusations for misdemeanor. An accused individual under the court proceedings is treated liable to the entire state law. In such cases, a criminal defense attorney like a Utah defense attorney can be of great help. Once the accused is proven to commit a certain crime, then they will given a sentence that is deemed for their mistakes. Most of the penalties include imprisonment, monetary penalty, community service and can also be a combination of those punishments mentioned.
