
Is it ever legal for a US citizen (non service person) to be tried by a military court?
Military courts: can they try regular citizens? Can the public attend a military trial? How about that trial with the Lincoln conspirators? Weren’t they tried in a military court without a lawyer, not allowed to speak, and the official transcripts are still classified?
A civilian who is in a combat zone is under the control of the UCMJ, and can be tried by military court. Unless an issue has classified details, the public is allowed to attend.
If a civilian is on a military base, and commits a crime, they are subject the prosecution under the U.S. District Court, with a Federal magistrate presiding.
