
Because the Union didn’t acknowledge the South as a separate country during the Civil War, can’t some of it’s?
actions taken against the states be considered illegal under the constitution?
Like when Fremont replaced the government of Missouri with one that supported the Union? And such.
Well I have always been of the opinion that the Southern States were always entitled to secede from the Union. After all they voted to join it, so why couldn’t they vote to leave it!
With regard to your question regarding Unconstitutional acts by the Union, or the Northern States if you like, I quote from the Constitution -
Section 3. New States
New States may be admitted by the Congress into this Union; but no new States shall be formed or erected within the Jurisdiction of any other State; nor any State be formed by the Junction of two or more States, or parts of States, without the Consent of the Legislatures of the States concerned as well as of the Congress.
So how did the formation of West Virginia comply?
Section 4 – Republican government
The United States shall guarantee to every State in this Union a Republican Form of Government, and shall protect each of them against Invasion; and on Application of the Legislature, or of the Executive (when the Legislature cannot be convened) against domestic Violence.
Speaks for itself.

Yeah right!

The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people.
Ah, so the people of the Southern States could vote to leave The Union.
