
Geneva Convention. Can you escape criminal charges?
Since it takes years to take someone to trial for war crimes. Is it possible to use a weapon that is banned under the Geneva convention in a civil matter, without facing prosecution by the CPS.
Say for instance I used a flamethrower or mercury tipped bullets to settle a dispute, would I be arrested for war crimes or the other thing? Would I go to a county court in the UK or be extradited to the Hague in Holland to face war crimes charges?
I guess I better declare war before I commit a crime then.
The nature of the weapon used is not the determinative factor.
Was the act committed during warfare and was in contrary to the Convention?
If so, it may be a war-crime.
If you use a flamethrower in the High Street you’ll be arrested for arson, or assault or possibly murder. You might make it to your local crown court. Not to the Hague.
